Bugfixes
IMAGE INSTRUMENTS will provide End User with bug fixes for the Software within a reasonable time. If a Distributor or End User finds what it believes to be a defect in a program, Distributor or End User shall immediately provide a written report containing reasonably specific information as to the nature of the defect and the conditions under which it occurs.
Distibutor and End User shall give all necessary support to IMAGE INSTRUMENTS. IMAGE INSTRUMENTS is not obliged to correct a defect, if End User cannot reproduce it or demonstrate it by using computer output. IMAGE INSTRUMENTS shall correct within an adequate period of time and at no cost to End User any defects which cause the programs to fail to meet the above warranty for bug fixes.
If a defect substantially restricts the use of the programs, IMAGE INSTRUMENTS shall provide a workaround, if needed.
IMAGE INSTRUMENTS may deliver the correction of defects that do not substantially restrict the use of the programs within the delivery of the next updated Software version.
IMAGE INSTRUMENTS shall develop workarounds insofar as these are technically feasible at acceptable costs to IMAGE INSTRUMENTS. End User must accept such a version, except if such version causes not acceptable efforts for adaptation and migration.
This warranty for bug fixes is expressly excluded if Distributor or End User modifies the programs or manipulates them in any other way. Modifications or manipulations carried out by a End User are attributed to Distributor.
